Week 5 Deliverables

This week, you will revise the first part of the paper according to your instructor’s comments. You will add additional articles, laws, cases and summary as outlined below. You will then combine all information and submit the final paper using the instructions provided.

Revise the paper submitted in Week 3.

Literature Review

For Week 5, locate two additional scholarly articles related to your topic. Summarize the articles in your own words and explain how they are related to your topic. Do not use published cases for this section. You must use scholarly articles from the South University Online Library. Legal journals may provide some of the best sources of information. Westlaw Campus Research is a good option for finding legal information in law journals. When you combine this section with Week 3, you will have a total of at least four articles.

Laws and Regulations

Research and analyze one additional law or regulation related to the topic you selected. The information may require research of federal and/or state laws, as well as administrative agency laws. Summarize the information about the law or regulation you found and explain how it applies to your topic. When you combine this section with Week 3, you will have a minimum of two laws or regulations. Depending on the topic, you may compare the laws of two states For example, if you are writing about gender discrimination, compare the federal law with law from one of the states that also provides protection at the state level. States often provide more protection than the federal law.

Cases

Research at least two additional published cases (lawsuits) related to the topic you selected. Summarize the cases in your own words and explain how they are related to your topic. Provide a summary that includes the name of the case, state or federal court, issue, summary of events and ruling. Explain whether you agree or disagree with the court’s decision. Combine the case from Week 3 with this section for a total of three cases.

Summary

  • Summarize what you have learned. Assess and communicate what you believe the future holds as it relates to your topic.
  • If applicable, discuss how you might apply what your learned to your personal or professional life.
  • Add the parts from Week 3 and submit your final paper in accordance with the formatting instructions provided.

Formatting Instructions

  • Submit a 10 to 14-page paper about the topic selected.
  • The paper should consist of a cover page, short introduction, explanation of the legal issue, literature review, analysis of related laws or regulations, reviews of cases, summary of information learned and application to your professional life, and a separate reference page.
  • Use APA format for the paper. Review the APA materials located in the Library Research Guide.

Draft Internal Memorandum

To refresh your memory of the Ann C. Dorite case, review her interview and your summary of her interview from module 02. For this assignment you just came out of a meeting with the partners of your firm, Susan & Winem. The meeting was short, but its contents were recorded by the partner’s secretary, Betsy M. Akurate, and she states that she will transcribe the meeting and provide a verbatim transcript.

The firm’s partner, Rich N. Moore, asks you to stay after the meeting. He then asks you to write an internal memorandum with two parts. He specifically states that he wants you to submit the memorandum in one Word document to him and he will circulate to the other attorneys.

The first part of the internal memorandum, Mr. Moore tells you, should be a summary of the meeting you just attended. He says Ms. Akurate will email you the transcript of the meeting.

For the second part of the internal memorandum Mr. Moore wants you to read statutes and cases for Ms. Dortie’s case. He is concerned that since the client was walking in the street the city had no legal duty to maintain the streets in a reasonably safe condition.

Partner Moore tells you that the memorandum (i) should be no more than 4 pages as he has no time to read more than 4 pages; (ii) should only discuss the case authority he will give you; (iii) should update the cases and provide him with the citation to the most recent Illinois case on the subject of pedestrian use of roadways with a 1-2 sentence statement of what the rule of law in the case; (iv) should frame the issue in the second half of the memorandum for the Dorite case using the 123 Method; and (v) should provide a list of points and authorities at the end of your memorandum.

Partner Moore’s secretary, Ms. Akurate, then sends you a memo with the following information:

Read as background and include in your list of points and authorities but not discuss in your memoranda the following statutes:
a. 745 ILCS 10/3-102 (2015);
b. 740 ILCS 130/2 (2015);
Read and discuss only the following cases:
Curatola v. Niles, 154 Ill.2d 201, 608 N.E.2d 882 (1993);
Gutstein v. City of Evanston, 402 Ill. App.3d, 929 N.E.2d 680 (App.Ct. 2010); and
Vaugh v. City of W. Frankfort, 166 Ill.2d 155, 651 N.E.2d 1115 (1995)

The memo concluded by saying if you had any questions or wanted to clarify the directions you should contact Mr. Moore’s partner Dan Walker by email as Mr. Moore will be out of town for the next week. She also reminded you attorney Moore likes a table of points and authorities at the end of the memo so he can put in the file for quick reference.

Conduct an analysis on the current state of the training program and address the current evaluation methods used. Reference should be made to specific quantifiable evaluation methods. The cost and benefit of the training should be presented.

The body of the paper will be 4-5 pages. This does not include extraneous pages like title page, reference page, appendices. APA formatting standards are required. A minimum of 5 scholarly resources need to be used. An example of a scholarly resource can be an interview with an HR professional or a peer reviewed article from a University Library Journal Database. Course materials and personal experience do not count. A formal third person tone is required.

Supplemental information (e.g. worksheets that are currently being used) can be presented in Appendices but do not count toward the body of the paper.

Note: Recommendations should not be made at this point – you will make these next week. This is an analysis of current standing. Keep in mind however, if an organization doesn’t deliver training, the paper doesn’t end at that point. Student needs to include a discussion of the different methods that could be used. Again, recommendations will be made next week
